These Terms of Service ("Terms") govern your use of the Fly Fearless Unlimited, LLC website at www.flyfearlesswithlindsay.com and all related products, services, content, and communities offered by Fly Fearless Unlimited, LLC, operating as Fly Fearless ("we," "us," or "our"). By accessing our website or purchasing any of our products or services, you agree to be bound by these Terms.

1. ABOUT OUR SERVICES

Fly Fearless offers personal development coaching, speaking engagements, workshops, events, books, digital content, and related products and services. Our work is centered on helping individuals recognize and shift internal patterns to create meaningful change in their lives.

Our services are designed for adults 18 and older. If a minor wishes to engage with our services, we ask that a parent or guardian be involved.

2. ACCEPTANCE OF TERMS

By accessing our website, purchasing a product or service, joining our community, or otherwise engaging with us, you acknowledge that you have read, understood, and agree to these Terms. We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.

3. COACHING AND SERVICES DISCLAIMER

All of our services are intended for personal development and educational purposes. Nothing we provide constitutes legal, medical, psychological, or therapeutic advice.

Coaching is not therapy and is not a substitute for professional mental health treatment. If you are currently under the care of a mental health professional, we recommend informing them of your coaching engagement.

You are solely responsible for your own decisions, actions, and outcomes. We do not guarantee specific results. Personal development work involves many variables, including your individual commitment, readiness, and circumstances. Any testimonials shared reflect individual experiences and are not a promise of the same results for everyone.

4. INTELLECTUAL PROPERTY

All content on this website and in our programs, products, and materials is the property of Fly Fearless and is protected by copyright and applicable intellectual property laws. This includes but is not limited to:

• The Fly Fearless brand name (trademark application pending) and logo (registered trademark)

• The Thermometer to Thermostat framework

• "The Attitude Expert" identity and associated content

• The book Whole. Loved. Free. and all associated content

• The Flight and its five sections (The Mask, The Mirror, The Fire, The Rise, and The Soaring), as featured in Cracking the Rich Code, Volume 18

• Contributions to The Art of Connection: 365 Days of Resilience

• All blog posts, videos, social media content, course materials, digital workbooks, ebooks, worksheets, and other written or recorded works

You may not copy, reproduce, distribute, modify, or use any of our content for commercial purposes without prior written consent. Personal, non-commercial use is permitted provided our authorship is clearly credited.

5. PAYMENT AND REFUND POLICY

All fees for services and products are due at the time of purchase unless otherwise specified. Prices are subject to change, but any rate increase will only apply to future bookings. The price you agreed to at the time of booking is locked in for that booking.

All sales are final. We do not offer refunds except at our sole discretion in circumstances where genuine value has not and cannot be delivered. Refund requests may be submitted to [email protected] and will be reviewed on a case-by-case basis.

We accept payment through Stripe, PayPal, Venmo, Square, and cash for in-person transactions. Payment card details are processed securely by our payment processors and are never stored by us.

6. CANCELLATION POLICY

For any scheduled service, session, or appointment, we ask that you provide at least 24 hours' notice if you need to cancel or reschedule. Missed appointments without advance notice will not be refunded or rescheduled unless otherwise agreed upon in advance. Where a separate service agreement exists, the cancellation terms in that agreement will govern.

7. CONFIDENTIALITY

We treat all information shared during coaching sessions, group programs, and workshops as confidential in accordance with professional coaching ethics standards. The coach-client relationship is not a legally privileged relationship in the way that attorney-client or doctor-patient relationships are, but we are committed to protecting your privacy.

Confidentiality does not apply in situations where disclosure is required by law or court order; there is a reasonable belief of imminent risk of harm to you or others; or the information involves illegal activity.

General themes from our work together may be shared anonymously with other coaching professionals for training and professional development purposes. No personally identifying information will be shared without your explicit written consent.

By engaging in our services, you consent to Fly Fearless using any testimonials, reviews, wins, or breakthroughs you share in sessions, in writing, or otherwise, for marketing and promotional purposes. We will never share personally identifying information without your explicit written consent.

8. SESSION RECORDINGS

We do not record sessions without the prior consent of all parties. If a session is to be recorded, you will be informed and asked for your permission before recording begins. Recordings are stored securely in our client portal, access to which is provided by invitation. Recordings are for your personal session replay purposes and are not shared publicly without your explicit written consent.

9. EVENTS

From time to time, we host live events, workshops, and speaking engagements. Photography or other documentation may occur at these events. Attendees will be notified in advance, and specific recording or photography consent will be addressed in any event-specific agreement.

We reserve the right to remove any attendee from an event for disruptive or inappropriate behavior, at our sole discretion, without refund.

10. COMMUNITY GUIDELINES

Our free Facebook community, Fly Fearless with Lindsay, is a space for growth, connection, and encouragement. By joining and participating, you agree to the following community standards:

• Lead with Love: Speak from kindness, not criticism. We lift each other up here. No judgment, gossip, or comparison.

• Be Real, Not Perfect: Share your truth, even if it's messy. This is a safe space to show up as you are, not who you think you should be.

• Faith Over Fear: We anchor everything we do in love, grace, and faith. Bring your questions, doubts, and breakthroughs. They all belong.

• Confidentiality is Sacred: What's shared in this community stays here. Respect each other's vulnerability and story.

• Give What You Want to Receive: Encourage others, engage with intention, and help this space stay full of light and healing energy.

We reserve teh right to remove any member from the community for behavior that violates these guidelines or creates a harmful environment for others. The community is not a space for solicitation, self-promotion, or pitching products or services to other members.

11. AFFILIATE DISCLOSURE

We may recommend products, tools, or programs through affiliate links, discount codes, or referral arrangements. This means we may receive compensation if you make a purchase through one of our links. This does not affect the price you pay. We only recommend things we genuinely use or believe in. Our recommendations are our own honest opinions.

12. THIRD-PARTY LINKS

Our website and community may contain links to third-party websites or resources. We are not responsible for the content, accuracy, or privacy practices of those sites. Links are provided for convenience only and do not constitute an endorsement.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we and our representatives and affiliates shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of our website, products, or services. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us for the specific product or service giving rise to the claim.

14. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our website or services, your violation of these Terms, or your violation of any rights of another party.

15. DISPUTE RESOLUTION

If a dispute arises out of these Terms that cannot be resolved by mutual consent, both parties agree to attempt mediation in good faith for up to 30 days. If the dispute remains unresolved, it shall be subject to the laws of the State of Alabama. In the event of legal action, the prevailing party shall be entitled to recover reasonable attorney's fees and court costs.

16. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of our website and services. They supersede any prior agreements or understandings. Clients engaging in coaching, speaking engagements, events, or other specific services will also be subject to a separate service agreement governing the terms of that engagement.
